But the Governor must appoint all Civil Officer Executive & Judicial by & with the advice of the Council. And in the forming & establisbing any Civil office he must not only act with the advice but have the Consent also of the Council.
When Matters things & Persons are so fast arranged these provisionary General Government of the whole Viceroyalty or State mus act & continué to act with all the powers of Government untill the organization of the Country be so far advanced, as that the Inhabitants can proceed to form, constitute & establish permanent Representation Governments in each Province. And a general Representative Government for the whole Viceroyalty or State.
Such Provisionary Government of the several Provinces, and such Provisionary General Government not remain in establishment longer that... Years, but at the expiration of that period, if there shall not have been a permanent Representative Government formed, tbe Inhabitant sball in like manner meet in like Conventions as aforesaid, and either continué the same Provisionary Governments, or change the form. or establish permanent Representative Governments. Nevertheless, if the Inhabitants do not change the existing Provisionary Government or establish permanent Representative Government. The Original Provisionary Government of each Province, and the Original existing Government General of the whole Viceroyalty or State shall remain in full power & establishment and continué to act as such for the further Period of… years.
The best Prudence or the most consummate Policy could not offer a better Example of Representative Government than the several States of N. America have adopted for each State according to their several & special circunstances nor a better example for a General Government than the Federal Government of the Unites States, consistting of three Branches, that is a Governor, a Council and a House of Representativos, all elected for a Prescribed period. Those who would profitt of this example must carefully observe the Following Matters. The may observe some defects in these Constitutions of Goverment, which Experience in practice has discover'd, as to the Ballance of power distributed amongst these three Branches.
They must take example from the wise Polecy of the N. Americans in building on old Foundations, consacrated by Time, and on which the habits & manners of tbe People & the Community have taken their Plis & Form. In so doing you must accommodate your Plan of Legislation, as far as is consistent with Personal & Political Liberty, to the

Dicho Gobierno Provisional de las distintas provincias y dicho Gobierno General Provisional no debe permanecer más de…….años, pero si al cabo de ese período no se ha formado un Gobierno Representativo permanente, los habitantes se reunirán de la misma manera en Asambleas parecidas a las antes mencionadas y, o continuarán con los mismos Gobiernos Provisionales o cambiarán la forma, o constituirán Gobiernos Representativos permanentes. Sin embargo si los habitantes no cambian el existente Gobierno Provisional ni establecen un Gobierno Representativo permanente, el Gobierno Provisional inicial en cada provincia y el existente Gobierno General inicial, del conjunto del Virreinato o Estado, quedará con plenos poderes y establecimiento, y continuará a obrar como tal durante un período adicional de...Años.
La mayor prudencia o la más completa política no podrían ofrecer un mejor ejemplo de Gobierno Representativo que el que han adoptado los distintos Estados de Norte América para cada Estado, conforme a sus distintas y especiales circunstancias, ni un ejemplo mejor de Gobierno General que el del Gobierno Federal de los Estados Unidos, que consta de tres partes: un Gobernador, un Consejo y una Cámara de Representantes, todos elegidos por un período prescrito. Aquellos que deseen beneficiarse de este ejemplo deberán observar cuidadosamente las siguientes cuestiones.
Observarán quizás algunos defectos en estas Constituciones de Gobierno, que la práctica de la experiencia ha descubierto, en cuanto al equilibrio del poder distribuido entre estas tres partes. Deben tomar ejemplo de la sabia política de los norteamericanos al construir sobre antiguas bases, conservadas por el tiempo y sobre las cuales las costumbres y modales del pueblo y de la comunidad han tomado hábito y forma.
